Car Park Terms of Entry

CAR PARK TERMS OF ENTRY 

RISK WARNING

USE OF THIS CAR PARK IS AT YOUR OWN RISK. RISKS INCLUDE DAMAGE, THEFT, INJURY, OR DEATH CAUSED BY OTHER PERSONS, WEATHER, CONDITION OF THE CARPARK OR EQUIPMENT FAILURE OR MALFUNCTION.

1.    Contract Formation:  By entering, you agree to these terms and form a contract with Secure Parking NZ Limited (NZBN 9429038348471) (referred to in these terms as “we”, “our” and “us”).  If you do not accept these terms, please exit the Car Park immediately to avoid charges. 2.    Rules & Payment:  

• Follow all signage and staff directions.
• Only park in bays marked “Reserved” if authorised.
• Pay using the provided method (e.g. app, meter) and follow the displayed fee schedule.
• You may only park for the time paid or the maximum allowed. 

3.    Breach & Fees:  If you breach these terms (e.g. overstaying, unauthorised parking, or non-payment), a $70 fee per day (or part thereof) applies.  If unpaid by the due date, a $20 admin fee applies.  You agree that these amounts reflect a reasonable pre-estimate of damages arising from your breach. If still unpaid after 10 days, you may also be liable for reasonable debt recovery costs, including legal fees. 

4.    Keys & No Safe Custody:  If you leave your vehicle keys with us, you authorise us to release your vehicle to any person producing a valid Car Park ticket for the vehicle or other proof entitlement satisfactory to us.  Staff are not authorised to accept goods for safekeeping.

5.    Vehicle Movement:  We may move your vehicle if reasonably necessary for safe or efficient operation of the Car Park, emergencies, obstruction, breach of these terms, or unpaid fees.

6.    Privacy:  We may use CCTV and licence plate recognition systems at this Car Park, which may capture images or video of you, your passengers, and other visitors to the Car Park.  This data may be used for fee calculation, security, incident investigation, and system training purposes (including by our related entities in Australia and Japan).  We will only use and share personal information as required or authorised by law, and in accordance with the Privacy Act 2020 and our Privacy Policy. If you do not provide us with this information, we may not be able to provide you with the parking services.

7.    Liability:  To the maximum extent permitted by law, (a) we exclude all terms, conditions, warranties, guarantees and any liability (including indirect or consequential loss) that might apply to us in respect of these Terms, however arising; and (b) you release us and we are not liable for any loss, damage, personal injury or death occurring in the Car Park, or loss or damage to any vehicle or personal property left with us, in the vehicle or in the Car Park; and (c) if we cannot exclude our liability by law, our liability is limited at our option, to the re-supply of the services or the payment of the cost of having the services supplied again. The Consumer Guarantees Act 1993 (CGA) provides consumers with guarantees that cannot be excluded, restricted or modified. These Terms do not affect any rights you have under the CGA or any other legal rights which cannot be excluded or modified.

8.    Indemnity:  You agree to indemnify us for losses or costs directly caused by your breach of these terms or your actions in the Car Park, including reimbursement of our costs of enforcement and/or vehicle movement.  Your liability is reduced to the extent that we reasonably caused or contributed to the loss. 

9.    No Guarantee of Security:  The word “Secure” in our name does not imply any guarantee of the security of the Car Park or your vehicle.
